How High? Insurance and Medical Marijuana in 2017

Location: Garden I

This CLE session focuses on the impact of medical marijuana on insurance coverages and underwriting. Part one of the program begins by defining common terms of art used in the medical marijuana industry, and providing a brief history of criminal laws on controlled substances and the movement towards legalization. Part two of the program discusses past legislation decriminalizing medical marijuana and expectations regarding 2017 and beyond. Part three details the impact of legalized marijuana on various lines of insurance coverage and compares and contrasts insurance coverage for legalized marijuana with other highly regulated substances such as alcohol and tobacco. Part four of the program concludes with a discussion of ethical obligations and pitfalls attorneys and insurance professionals may face when advising their clients on this emerging industry, including a survey of how various state bars have handled this issue.

Learn successful career strategies, develop your professional network, apply it to your career and move from a benchwarmer to a starter! Sources of Success Part 1 will be divided into 2 components. The first half of the session will be led by Michelle Banks, former Executive Vice President and Global General Counsel for Gap Inc., and Charles H. Corporate Social Responsibility (CSR) efforts in the environmental space have focused mostly on environmental sustainability. However, the public’s exposure to a company’s environmental risk profile is much broader than that. Many companies have been driven into bankruptcy by the weight of various environmental liabilities, and when that happens, the public invariably ends up sharing the burden of those liabilities. Being prepared to respond effectively in emergency situations is crucial for companies, but engaging in proactive efforts to prevent environmental liabilities from emerging in the first place is typically a far more cost-effective approach. This CLE focuses on how companies can use the environmental diligence process typically reserved for transactions (where an acquiror or investor seeks to assess and mitigate the environmental risk and liabilities associated with a target company or business) as a CSR benchmark to signal a proactive and holistic approach to managing one’s environmental liabilities.

EEOC You Soon? Under Investigation by the EEOC: Prevention and Defense Strategies to Avoid Claims of Systemic Discrimination
